If we cannot resolve a dispute informally, any controversy or claim arising out of or relating to these Terms shall be settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall be held in Columbus, Ohio, and judgment on the arbitration award may be entered in any court having jurisdiction thereof.
All disputes shall be resolved on an individual basis. You agree not to bring or participate in any class, consolidated, or representative action against VEREGY EAST, LLC.
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government actions, pandemics, supply chain disruptions, labor disputes, and interruptions in utilities or telecommunications.
